These Terms of Service ("Terms") govern your access to and use of the website located at helmetshop.com (the "Site") and any purchases you make from The Helmet Shop ("The Helmet Shop," "we," "us," or "our"). By accessing the Site, creating an account, or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site or purchase from us.

2. Eligibility

You must be at least 18 years of age, or the age of legal majority in your jurisdiction, to make a purchase or create an account. By using the Site, you represent that you meet this requirement and that all information you provide is accurate and complete. Purchases made on behalf of a minor are the responsibility of the supervising adult.

3. Accounts

You may be able to create an account to streamline checkout, track orders, and participate in our rewards program. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly at sales@helmetshop.com if you suspect unauthorized use. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Products, Descriptions & Pricing

We make every effort to display product details, colors, certifications, and pricing accurately. However, we do not warrant that product descriptions, images, sizing information, or other content is error-free, complete, or current. Colors may vary depending on your display.

All prices are listed in U.S. dollars and are subject to change without notice. In the event a product is listed at an incorrect price or with incorrect information due to a typographical, system, or supplier error, we reserve the right to cancel or refuse any order placed for that product, whether or not the order has been confirmed and your payment method charged. If we cancel an order after your payment has been processed, we will issue a full refund.

5. Orders & Order Acceptance

Your submission of an order constitutes an offer to purchase. All orders are subject to acceptance by us, and we may, at our sole discretion, decline or cancel any order for any reason, including suspected fraud, product unavailability, errors in pricing or product information, or limits on quantities purchased per customer or per order. A confirmation email acknowledges receipt of your order; it does not constitute our acceptance.

6. Payment

We accept the payment methods displayed at checkout, which may include major credit cards, Apple Pay, Google Pay, PayPal, and Shop Pay. By submitting payment information, you represent that you are authorized to use the payment method and authorize us to charge your order total, including taxes and shipping where applicable. Payment processing is handled by third-party providers subject to their own terms.

7. Shipping & Delivery

Shipping options, costs, timeframes, and restrictions are described in our Shipping Policy, which is incorporated into these Terms by reference. Title and risk of loss for products pass to you upon our delivery of the products to the carrier. Delivery estimates are not guaranteed, and we are not responsible for carrier delays.

8. Returns, Refunds & Exchanges

Returns, refunds, and exchanges are governed by our Return Policy, which is incorporated into these Terms by reference. For health, safety, and hygiene reasons, certain items may be non-returnable once worn, used, or with safety seals or tags removed, as further described in that policy.

9. Helmets & Safety Equipment — Important Notices

Helmets and other protective gear are safety-critical products. By purchasing such items from us, you acknowledge and agree to the following:

• No guarantee against injury. No helmet or piece of protective equipment can prevent all injuries or guarantee your safety in any accident, fall, or impact. Protective gear is designed to reduce, not eliminate, the risk of injury.
• Proper fit and use. A helmet only performs as intended when it fits correctly, is properly fastened, and is used in accordance with the manufacturer's instructions. It is your responsibility to select the correct size and to follow all manufacturer guidance.
• Single-impact and replacement. Most helmets are designed to absorb a single significant impact and should be replaced after any crash or substantial impact, even if no damage is visible. Helmets also degrade over time and should be replaced according to manufacturer recommendations.
• Certifications. Safety certifications (such as DOT, ECE, or Snell) describe testing standards met at the time of manufacture; they are not a promise of protection in any particular incident. You are responsible for confirming that a product meets the legal requirements of the jurisdiction in which you ride.
• No resale of used safety gear. We sell new products and do not warrant the safety or integrity of any helmet that has been dropped, modified, exposed to chemicals or extreme conditions, or otherwise altered after purchase.

10. Fitment & Compatibility

Where we provide fitment, sizing, or compatibility information (for example, shields, cheek pads, liners, communication systems, or mounting accessories), it is offered as a general guide only. You are responsible for verifying that a product fits your specific helmet, vehicle, or equipment before use. We are not liable for products purchased based on incorrect compatibility assumptions.

11. Manufacturer Warranties

Products are covered solely by the warranties, if any, offered by their respective manufacturers, and warranty claims are subject to the terms and processes of those manufacturers. The Helmet Shop does not provide independent product warranties beyond those required by applicable law. We will assist you in directing valid warranty claims to the appropriate manufacturer where reasonably possible.

12. Authorized Dealer

The Helmet Shop is an authorized dealer for the brands we carry. All trademarks, brand names, and logos belonging to manufacturers are the property of their respective owners. Their appearance on the Site does not imply endorsement of these Terms by those manufacturers.

13. Customer Reviews & User Content

If you submit reviews, ratings, photos, comments, or other content ("User Content"), you grant The Helmet Shop a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, modify, display, and distribute that content in connection with our business, including marketing. You represent that you own or have the right to submit the content and that it does not violate any third party's rights or any law. We may, but are not obligated to, monitor, edit, or remove User Content at our discretion.

14. Rewards & Loyalty Program

Participation in any rewards or loyalty program we offer may be subject to additional program-specific terms, which are made available within the program and are incorporated by reference. We reserve the right to modify, suspend, or discontinue any rewards program, and to adjust or revoke points or rewards obtained through error, fraud, or violation of program terms.

15. Intellectual Property

The Site and its original content, design, layout, text, graphics, and compilation are owned by The Helmet Shop or its licensors and are protected by U.S. and international intellectual property laws. You may not copy, reproduce, republish, distribute, or create derivative works from any part of the Site without our prior written permission, except as necessary for your personal, non-commercial use of the Site.

16. Prohibited Uses

You agree not to use the Site to: violate any law or regulation; infringe the rights of others; transmit malware or harmful code; attempt to gain unauthorized access to our systems; scrape, harvest, or collect data without permission; interfere with the proper functioning of the Site; or engage in fraudulent activity. 19. Limitation of Liability

21. Governing Law & Jurisdiction

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law principles. You agree that any dispute not subject to the dispute-resolution section below shall be brought exclusively in the state or federal courts located in Volusia County, Florida, and you consent to the personal jurisdiction of those courts.

22. Dispute Resolution

In the event of a dispute, you agree to first contact us at sales@helmetshop.com so that we may attempt to resolve the matter informally.
